T2eUK Limited Acceptable Use Policy ("AUP")
T2eUK Limited requires that each of its customers accept and agree to T2eUK Limited Terms of Service, a copy of which is available at http://www.t2euk.com/termsofservice
The Terms of Service constitute a legal agreement between the customer and T2eUK Limited. In the Terms of Service, each customer agrees, among other things, to be bound by the terms and conditions of this AUP.? ?This AUP also binds all users of and visitors to T2eUK Limited services and Web sites: by the act of using T2eUK Limited services or visiting its Web sites, all such users and visitors agree to be bound by this AUP.
(Customers, users, and visitors are referred to herein collectively as "Customers.")
Please note that this AUP is subject to change, and it is Customer's responsibility to regularly check for modifications. T2eUK Limited requires that all Customers conduct themselves as good citizens of the
Internet and at all times behave with respect for others. Each Customer is responsible for preventing violations of this AUP by third parties accessing T2eUK Limited services through Customer's computers or accounts, including without limitation hackers and Customer's own users.
A. The following activities are expressly prohibited:
1. Spam / E-mail Marketing.
T2eUK Limited does not tolerate Spam or e-mail marketing of any kind, whether legal or illegal . Do not send more than one hundred (100) unsolicited e-mails during any twenty-four (24) hour period. Any message sent to a recipient from a purchased, rented, licensed, or traded list of e-mail addresses is automatically considered unsolicited. (Messages forbidden by this paragraph are collectively referred to herein as "E-mail Marketing.")(E-mail Marketing creates a risk that T2eUK Limited will be blacklisted from other networks and so could adversely affect other T2eUK Limited Customers and Resellers.) Do not violate the CAN-SPAM Act of 2003. Do not send E-Mail Marketing Messages or facilitate E-Mail Marketing, even if such conduct is CAN-SPAM compliant. Do not host or allow to be hosted any site or information that is advertised by E-Mail Marketing, even if such conduct is CAN-SPAM compliant.
Do not set up an open mail relay that is not password protected or that could allow anyone to send E-Mail Marketing Messages.
??Some of the terms of this AUP may overlap terms of the T2eUK Limited Terms and Conditions. In the event of
any inconsistency, the T2eUK Limited Terms and Conditions will govern the relationship between T2eUK Limited and Customer.
T2eUK Limited Acceptable Use Policy ("AUP")
2. Hacking or perpetration of any security breach.
3. Unauthorised access to any computer or system , including intrusion into or scanning of other T2eUK Limited accounts.
4. Dissemination of deliberately offensive material , including any message or information that is or may be threatening, libellous, obscene, or harassing.
5. Child pornography or any other activity harmful to minors.
6. Fraud.
7. Violations of privacy rights.
8. Intellectual property infringement , including violations of copyright, trademark, or patent rights, or use or distribution of pirated software. (Please see T2eUK Limited policy regarding Intellectual Property infringement, at http://www.t2euk.com/intellectualproperty)
9. Use of third party software without a proper license or other appropriate permission, including Microsoft software.
10. Network attacks or any unfriendly effort to interfere with service on another network or server.
11. Virus distribution or distribution of any worm or other harmful code.
12. Illegal activities of any kind.
13. Use of Internet relay chat ("IRC") , including hosting of an IRC server, running IRC bots, use of a T2eUK Limited server as an IRC client or proxy, and use of IRC scripts or programs that interfere with service to other users on any server or network .
B. Adult Content:
T2eUK Limited does not allow hosting of adult content at all and all questions and special agreements should be agreed before a website is uploaded.
C. Investigations, disruptions, & security:
T2eUK Limited reserves the right to disable service or terminate service and/or to remove content in order to investigate suspected violations of this AUP or of the Terms of Service without first giving notice . The cost of any investigation will be charged to the Customer at £75.00 per hour, in addition to charges for Legal fees
and related expenses (if any). T2eUK Limited furthermore reserves the right to disable Customer's service if T2eUK Limited suspects that such service is the target of an attack or in any way interferes with service s provided to other customers, even if Customer is not at fault. T2eUK Limited does not issue refunds for terminating service due to any of the causes specified above.
T2eUK Limited Acceptable Use Policy ("AUP")
Customer is responsible for the use of its service, including transfer and bandwidth, even use by unauthorised users or hackers. Customer is responsible for maintaining security, including disaster recovery systems and backups. (Customer is advised to maintain backups on its own premises Unless otherwise specified with a T2eUK Limited Backup agreement.)
D. Reporting AUP Violations:
T2eUK Limited requests that anyone with information about a violation of this AUP, or of T2eUK Limited Terms of Service, report it by sending an e-mail to abuse@t2euk.com.
E. Monitoring & Disclaimers:
T2eUK Limited has no obligation to monitor its services but may do so and may disclose information regarding use of the services for any reason, including: to satisfy laws, regulations, or governmental, legal, or law-enforcement requests; to operate such service properly; or to protect itself and its customers. T2eUK Limited may grant law enforcement agencies access to its equipment to monitor use of its services.
T2eUK LIMITED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. T2eUK LIMITED DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. T2eUK LIMITED MAKES NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. NO ADVICE
PROVIDED BY T2eUK LIMITED OR ANY OF ITS REPRESENTATIVES WILL CREATE A WARRANTY.
T2eUK LIMITED WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR MULTIPLE DAMAGES, EVEN IF T2eUK LIMITED WAS ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES. T2eUK LIMITED MAXIMUM LIABILITY ARISING OUT OF OR RELATED TO PROVISION OF ITS SERVICES WILL NOT EXCEED THE TOTAL AMOUNT OF FEES BILLED TO CUSTOMER DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
T2eUK LIMITED WILL HAVE NO LIABILITY WHATSOEVER FOR ANY CLAIMS, LOSSES, ACTIONS, DAMAGES, SUITS, OR PROCEEDINGS RESULTING FROM:
(i) OTHER T2eUK LIMITED CUSTOMERS OR THIRD PARTIES ACCESSING CUSTOMER'S DATA OR ASSIGNED COMPUTERS;
(ii) SECURITY BREACHES;
(iii) EAVESDROPPING;
(iv) DENIAL OF SERVICE ATTACKS;
(v) INTERCEPTION OF TRAFFIC SENT OR RECEIVED USING T2eUK LIMITED SERVICE;
(vi) CUSTOMER'S RELIANCE ON OR USE OF THE SERVICE;
(vii) MISTAKES, OMISSIONS, INTERRUPTIONS, DELETIONS OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION, OR OTHER FAILURES OF PERFORMANCE OF THE SERVICE;
(viii) THE ACCURACY, COMPLETENESS, AND USEFULNESS OF THE SERVICE; OR
(ix) LOSS OF DATA OR LOSS OF ACCESS TO DATA.
T2eUK Limited limitations and exclusions of liability apply equally to T2eUK Limited officers, employees, agents, contractors, representatives, suppliers, subsidiaries, parents, and affiliated companies.
T2eUK Limited policies and procedures for handling customer information have been created with the understanding that Internet technologies are still evolving and that Internet business methods are continuing to evolve to meet the needs and opportunities of the changing technologies. As a result, T2eUK Limited policies and procedures are subject to change.
In the course of serving its customers, T2eUK Limited acquires stores and transmits customer communications and information that customers may regard as private or sensitive. Some of this information - such as the customer's name, address, telephone number, and credit card data - is provided to T2eUK Limited by its customers in order to establish service. Other information - such as the customer's account status, choice of services, and customer logs - is created and maintained by T2eUK Limited in the normal course of providing service. T2eUK Limited also uses cookies, which are small pieces of information that a web site can store in a designated file on a user's computer for various reasons. For example, T2eUK Limited uses cookies on the landing pages of products sold online which record the customer information that is required on the order form. This information is then forwarded to an internal sales tracking database within T2eUK Limited. In addition, T2eUK Limited may store customers' electronic mail and other communications as a necessary incident to the transmission and delivery of those communications.
Data Security
T2eUK Limited will protect the confidentiality of its customers' information, account information and personal communications in consistency with the law and the legitimate interests of T2eUK Limited, its partners, its employees and other customers of T2eUK Limited's services.
In an effort to keep customer data confidential, all T2eUK Limited employees are required to sign an Employee Confidentiality Agreement that includes the following statement to protect customer data:
Third Party Information. I recognise that the Company has received and in the future will receive from third parties their confidential or proprietary information subject to a duty on the Company's part to maintain the confidentiality of such information and to use it only for certain limited purposes. I agree to hold all such confidential or proprietary information in the strictest confidence and not to disclose it to any person, firm or corporation or to use it except as necessary in carrying out my work for the Company consistent with the Company's agreement with such third party.
T2eUK Limited is under contract with a professional employment organisation (PEO) to insure that all existing employees and all new hires have executed the confidentiality agreement and a copy is maintained on file by the PEO.
How is customer information used?
T2eUK Limited may use customer information to provide its customers with system information or information about new or upgraded products. T2eUK Limited does not rent, sell, or share customer data or personal information with any third parties.
Opt Out & Modifications
Customers may opt out of receiving notices of new or upgraded products from T2eUK Limited and T2eUK Limited partners by sending an Email to marketing [at] t2euk.com, or by following the unsubscribe instructions at the bottom of any Email notice that they receive from T2eUK Limited. However, customers may not opt out of receiving information from T2eUK Limited which is essential for maintaining or updating customers' accounts or system information.
Most customers may access and modify their personal information via their online personal control panel/account information page. All other customers may access and modify their personal information by contacting the appropriate T2eUK Limited Billing organisation.
Disclosure of customer information and communications
T2eUK Limited will not otherwise disclose its customers' personal and account information unless T2eUK Limited has reason to believe that disclosing such information is necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of T2eUK Limited, T2eUK Limited's customers, or others, or where T2eUK Limited has a good faith belief that the law requires such disclosure.
T2eUK Limited also will not, except for reasons stated below, disclose to third parties the contents of any electronic mail or other electronic communications that T2eUK Limited stores or transmits for its customers. The circumstances under which T2eUK Limited will disclose such electronic customer communications are when:
- it is necessary in order to provide service to the customer;
- it is necessary to protect the legitimate interests of T2eUK Limited and its customers;
- it is required to cooperate with interception orders, warrants, or other legal process that T2eUK Limited determines in its sole discretion to be valid and enforceable; and
- it is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by T2eUK Limited and appear to pertain to the commission of a crime.
T2eUK Limited disclaims any intention to censor, edit or engage in ongoing review or surveillance of communications stored on or transmitted through its facilities by customers or others. T2eUK Limited will, however, review, delete or block access to communications that may harm T2eUK Limited, its customers or third parties. The grounds on which T2eUK Limited may take such action include, but are not limited to, actual or potential violations of T2eUK Limited's Acceptable Use Policy.
